High Court restores elected body of Karnataka Medical Council

BENGALURU: The Kalaburagi Superior Tribunal has reinstated the elected organ of the Medical Council of Karnataka (KMC), observing that elections to the statutory organ cannot be overturned by an autonomous tribunal that does not have legal jurisdiction.
However, he rejected the order of the single bench, comprising Justices R Devdas and CM Joshi, saying that the candidates chosen by him should be allowed to assume charge and complete the mandate from the date of assumption of charge. l cargo.

The tribunal had only allowed the petition filed by Dr Gachinmani Nagnath, a KMC member from Kalaburagi. The ruling party had ordered new elections to be held within a period of six months, saying that the electoral process held in 2020 was tainted by fraud. The final list of voters published by the scrutinizer on 10 January 2020 was also cancelled.

As a result, the elections held on 23 January 2020 and the results declared on 25 January 2020 were also cancelled. The single tribunal had also ordered the state government to initiate disciplinary proceedings against the investigator and hand it over to the Lokayukta.

This order was challenged by Dr. Madhusudan Kariganur and 11 other persons elected in the election and the investigator Pandurang Garaj. Appeal resources were presented separately. The Rectors argued that only an electoral tribunal so constituted could declare the election or its results void or illegal.

The division’s bank contested the dispute. The bench said that the single bench could not cancel the list of voters nor declare the results of the election void.
