High court directs SP to provide police protection to son for performing mother’s last rites

Chhattisgarh High Court has ordered the Bastar Superintendent of Police to provide necessary security to perform the last rites of a deceased woman of a family who has converted to Christianity on her private land as per the wishes of her family. Ramlal Kashyap of Errakot village of Bastar district filed a petition through his advocate Praveen Tulsyan and told that his mother died a natural death on 28 June. After this, he wanted to bury his mother on his land but the police of Parapa police station stopped him from doing so and said that he should take the body 15 km away to Korkapal village and bury it, where a separate cemetery has been built. The petitioner does not want to do this.

The advocate said that the petitioner has the constitutional right to perform the last rites of his mother in a respectful manner as per his wish. He cited a similar order of the High Court in April regarding a dead person from Chhindbahar in Bastar. The court had given the verdict in favor of the petitioner. Citing an order of the Supreme Court against Mohammad Latif of Jammu and Kashmir, the petitioner’s lawyer said that preventing the burial of the body in a respectful manner according to the wishes of the family is a violation of Article 21 of the Constitution. bilaspur

Deputy AG Praveen Das, appearing on behalf of the government, said that the said village is dominated by tribals who believe that cremating a person who has converted his religion in the village, even if it is his private land, brings evil to the village. Allowing the body to be buried in the village can lead to disputes and law and order problems. The petitioner’s lawyer objected to this and said that conservative beliefs cannot be placed above the provisions of the Constitution. A single bench of Justice Parth Pratim Sahu, while giving the verdict in favor of the petitioner, has asked the management of Medical College Jagdalpur to immediately hand over the body to his son. The court has asked the SP of Bastar to provide adequate security to the petitioner to perform the last rites of his mother on private land.
