On the petition of the wife, the High Court reprimanded the drunken husband
Bilaspur. The husband is responsible for not fulfilling the responsibility towards the wife and children by drinking more alcohol and the economic condition of the family worsens. This is cruelty towards wife and children. A bench of Justice Gautam Bhaduri and Justice Sanjay S Aggarwal made this comment while hearing the wife’s petition against the order of the Family Court. Setting aside the order of the Raigarh Family Court, the High Court has granted a decree of divorce in favor of the wife. Also, as the wife has no source of income, the husband has been ordered to pay Rs 15,000 per month as maintenance for her and the children. The woman living in Raigarh was married to Umesh Sharma of Durg in the year 2006. After marriage they had a son and a daughter. The husband had a habit of drinking alcohol.
After drinking too much, he used to beat his wife and used to sell household items for alcohol. He didn’t even do any work. Even did not fulfill the responsibilities of the house. Even the school fees of the children could not be deposited. On May 26, 2016, under the influence of alcohol, he assaulted and abused his wife and children, due to which the woman had gone to her maternal home.
The woman finally filed a case for divorce in the family court. In this, a demand for divorce was made on the ground of cruelty of the husband. The Family Court of Raigarh rejected the application on 30 October 2021. The woman appealed against the court’s order in the High Court. A hearing was held on this in the bench of Justice Gautam Bhaduri and Justice Sanjay S. Agarwal.
Accepting the application of the wife, the High Court has set aside the order of the Family Court of Raigarh. The High Court has said in the decision that after marriage, one cannot escape from the responsibility of husband and father, especially when the wife is not working. Failure to fulfill the responsibility and because of this the family has to go through financial difficulties is certainly cruelty to the wife and children.
