Refusal to grant leave for NEET counselling, Himachal HC considered extremely unjust
Shimla (ANI): The Himachal Pradesh High Court has found the Director Health Services wrong in refusing to grant No Objection Certificate (NOC) to a senior resident doctor for attending NEET Super Specialty Course counseling and not allowing additional ordinary leave. Is. Himachal Pradesh, highly unjust and arbitrary.
Justice Ranjan Sharma passed this order on a petition filed by Anupam Sharma. The petitioner YS Parmar is working as Senior Resident (General Surgery) in Government Medical College, Nahan. He appeared for the NEET Super Specialty Examination 2023 conducted by the National Medical Commission and qualified for the above examination.
After qualifying the examination the petitioner applied to the Director of Health Services for issue of NOC and grant of extraordinary leave, so that he would be able to pursue higher education of NEET Super Specialty Course.
The respondents neither accepted the petitioner’s request nor communicated any decision in this regard. The petitioner was verbally told on November 6 that NOC could not be issued. The petitioner was left with no other option but to approach the High Court.
The Court observed that the respondent sleeping on the matter and neither considering it nor giving any decision was tantamount to depriving the petitioner of his rights.
The Court said that fairness demands that the respondents should consider the matter and pass appropriate orders. The Court further said that the action of the State authorities is not only condemnable but also leads to arbitrariness and distortion.
The Advocate General appearing for the respondents argued that as per the provisions of the policies made in this regard, no NOC is to be granted, but after perusing the policies, the Court found that NOC cannot be granted for the second postgraduate course Is. No claim by the petitioner.
The court directed the respondents to immediately issue NOC in favor of the petitioner and also hand over the original certificates of the petitioner, so that he is able to participate in the counselling. (ANI)
