Court orders to frame murder charges in case of shopkeeper’s death

Panaji: A North Goa court has ordered that murder charges be framed against Gajanan Pawar, who allegedly killed a fellow shopper over an argument over queue jumping at the DG-Mart on Kadamba Bypass Road in 2021. Was.
Pawar reportedly broke the queue at the cashier counter at DG-Mart and stood in front of the deceased’s wife. As a result, an argument broke out between the deceased and Pawar, following which Pawar left the place.

In her complaint to the police, the deceased’s wife said that when she and her husband reached near their parked two-wheeler, Pawar came towards them and started arguing with her husband.

She then gave a blow to her husband, due to which he fell on the ground and became unconscious. He died of his injuries a few days later. Government lawyer A Talolikar said there was enough material to frame murder charges against Pawar as he had attacked a vital part of the deceased’s body, the head, which ultimately resulted in his death.

However, Pawar said the case was one of culpable homicide. He said murder charges should not be laid as he had no intention of killing the deceased. Pawar told the court that his actions came out of impulse.

However, the court disagreed and said charges should be framed for murder. “If the evidence produced by the prosecution proves that the offense of culpable homicide is made out, the accused can be convicted for this lesser offense of culpable homicide. Conversation is not allowed,” said Sessions Judge, Panaji, Sherin Paul.
