Decision to close POCSO case against Brij Bhushan on January 11
New Delhi ; A Delhi court has ordered whether to accept the quashing report of the Delhi Police in the sexual assault case filed by a minor wrestler against former Wrestling Federation of India (WFI) chief and BJP MP Brij Bhushan Sharan Singh. The announcement has been postponed to January 11, 2024. Patiala House Court Additional Sessions Judge (ASJ) Chhavi Kapoor adjourned the case saying the order was not ready.
The police cancellation report was filed on June 15, and was not contested by the complainant during the previous hearing. On August 1, the alleged victim and her father had expressed satisfaction with the police investigation while expressing no objection to the police report in the case. He had recorded his statement in the proceedings in the chamber before ASJ Kapoor. On July 4, the court had sought a response from the complainant on the police’s cancellation report.
The 550-page report filed by the police in the Patiala House Court had said that no corroborative evidence was found in the allegations made by the minor. Delhi Police said, “After completion of investigation in the POCSO case, we have submitted a report under Section 173 of CrPC, in which a request has been made to quash the case on the basis of the statements of the complainant i.e. the victim’s father and the victim herself. “
The FIR on the allegations made by the minor was registered under the Protection of Children from Sexual Offenses (POCSO) Act as well as relevant sections of the Indian Penal Code (IPC) along with the act of outraging modesty. However, the minor wrestler’s father later came forward and claimed that he had filed a “false” complaint of sexual harassment against Brij Bhushan. The father alleged that his actions were motivated by anger and frustration over the alleged biased behavior of the WFI chief towards his daughter. According to sources, the minor’s second statement under section 164 of CrPC was recorded in the court on June 5, in which she withdrew the sexual assault allegations against Brij Bhushan.
