Hearing on Hemant Soren’s petition against ED in Supreme Court now on September 18
Ranchi (IANS). The petition filed against ED by Jharkhand Chief Minister Hemant Soren will now be heard in the Supreme Court on September 18.
The petition was listed for hearing in the court of Supreme Court judges Justice Aniruddha Bose and Justice Bela M Trivedi, but due to the ill health of senior advocate Mukul Rohatgi, who argued on behalf of Hemant Soren, they heard the case for a week. Requested to postpone.
The court accepted this request.
Let us tell you that Soren has challenged the summons sent to him by ED for questioning. In his petition, he has questioned the validity of Sections 50 and 63 of PMLA (Prevention of Money Laundering Act) 2002.
The investigating agency has the right to record the statement under Section 50 or arrest anyone during interrogation. Therefore, there remains a fear of arrest after issuing summons.
CM Hemant Soren has requested the Supreme Court to postpone the summons and order the ED not to take coercive action.
Let us tell you that ED had sent summons to Hemant Soren thrice in August and asked him to appear at the ED’s zonal office in Ranchi for questioning. Soren did not appear on any of these summons.
He had written a letter to the ED’s assistant director, terming the ED’s action as politically motivated. He had informed ED that he has filed a writ petition in the Supreme Court against this action, hence will not appear before the agency till the hearing on it.
