Madras HC Order: Directs Response on Guaranteed Pension Scheme Within 8 Weeks

Tamil Nadu: The Madras High Court has directed the Tamil Nadu government to file its response within eight weeks to a petition seeking the formulation and notification of necessary rules for the implementation of the Guaranteed Pension Scheme.

This petition was filed on behalf of Nandagopal, the State Coordinator of the ‘Tamil Nadu Old Pension Scheme Restoration Movement,’ along with three district coordinators. The petitioners stated that the State Government has announced a new Guaranteed Pension Scheme for government employees, which is slated to come into effect from January 2026.

The petition notes that, under this scheme, benefits are also intended for employees who retired from service after the introduction of the old Contributory Pension Scheme but prior to the year 2026. It mentions that there is a provision to grant a special compassionate pension to such employees.

However, the petitioners further submitted that, to date, no rules, guidelines, or Standard Operating Procedures (protocols) have been formulated for the implementation of this scheme. They argue that if the rules and procedures are not clearly defined, eligible employees will face difficulties in availing the pension benefits.

On these grounds, the petition seeks a directive to the State Government to formulate the necessary rules and officially notify them as expeditiously as possible, thereby ensuring that the benefits of the scheme are implemented in a timely and transparent manner.

The matter was heard at the Madras High Court before the bench of Justice P.D. Audikesavalu. After hearing the preliminary arguments from both sides, the Court directed the State Government to file its counter-affidavit to the petition within eight weeks.

The Court has, for the time being, adjourned the next hearing of the case. Following this directive from the Court, the Tamil Nadu government must now clarify its stance regarding the rules governing the scheme and the modalities of its implementation.

This case is considered significant as it pertains to the pension system within the state and the interests of retired employees. All eyes are now fixed on the government’s response and the subsequent legal proceedings.
