In this case, the full-time chairman of the permanent Lok Adalat Ajay Kumar Sharma has imposed a fine of Rs 3 lakh on the CHC in-charge and the CMHO. Out of this, 30 thousand rupees have already been given to the woman by the government. In this case, Rs 5,000 as complaint expenses should be paid along with the remaining Rs 2.70 lakh. Complainant Manju Devi (24) wife Hiralal Meena resident of Thumdi Nangal Rajawatan. After Manju Devi had a daughter Himanshi and a son Anees, the couple had undergone sterilization on 8 February 2021, so that they could not have a third child. After about 6 months, when the sterilization failed, the woman became pregnant and then she gave birth to a son as the third child. When a complaint was filed against this in the Permanent Lok Adalat, instead of accepting it as wrong, the medical in-charge argued that the woman never underwent a medical examination after the sterilization operation, nor was any information given regarding menstruation. Also said that on failure of sterilization, the department has fixed a compensation amount of Rs 30 thousand, which has been given to the woman on December 22, 2022. At the same time, advocate Shiv Shankar Sharma presented the documents related to sterilization. from the side of the woman. Along with this, the Madras High Court had ordered a compensation of Rs 3 lakh on April 28-23 for the failure of the sterilization; After hearing the documents and both the sides, the judgment was pronounced in the presence of full-time Chairperson Ajay Kumar Sharma and Members Ashok Kumar Sharma and Suresh Kumar Goel. In this, ordered to pay Rs 2.70 lakh to the applicant i.e. medical in-charge Papadda and CMHO complainant woman and Rs 5 thousand as complaint expenses. The decision has to be implemented in 2 months.
