Summons issued to BJP leader, court sent in rape case
Delhi. A Delhi court has summoned BJP leader Syed Shahnawaz Hussain in a case of alleged rape and intimidation. The judge has taken cognizance of the offenses of rape (punishable under section 376 of the Indian Penal Code) and criminal intimidation (section 506). The court has rejected the Delhi Police report in the rape case, giving a clean chit to Shahnawaz Hussain. Was given. The court has rejected the police’s cancellation report. The complainant relied on the decisions of the Supreme Court, which showed the court that if the sole testimony of the prosecutor is credible, it is sufficient to convict the accused. The court said, “It is, therefore, safe to say that the sole consistent testimony of the prosecutor is sufficient to summon the accused and take the case to trial.”
Earlier, the Delhi High Court had quashed the sessions court’s order to register an FIR against Shahnawaz and his brother Shahbaz Hussain. Justice Amit Mahajan, after giving the petitioners an opportunity of being heard, sent the case back to the sessions court for a fresh decision. The bench said that the trial court did not listen to Hussain and his brother while directing the registration of FIR under sections 420, 376, 295A, 493, 496, 506, 509, 511 and 120B of the Indian Penal Code. The court said that earlier the Metropolitan Magistrate, by order dated June 25, 2018, had refused to direct the police to register an FIR in an application filed by the woman under Section 156 (3) of the CrPC. Later, the Sessions Judge, while quashing the said order of impugned order dated 31st May 2022, directed SHO Mandir Marg to register the FIR.
The complainant had alleged that she met Shahbaz when she was running an NGO. Shahbaz introduced himself as the brother of Member of Parliament Shahnawaz Hussain and after being highly impressed by him, he developed closeness with him. The complainant said he promised her that he would marry her and allegedly raped her. At first she did not reveal the matter because she was worried about her dignity and reputation, but when she came to know that Shahbaz was already married and the father of two children, she was shocked. She then went to her brother’s residence to seek his support and justice and told him the entire story. The complaint states that Shahnawaz had asked him not to expose the matter and create ruckus as it would be harmful for both the parties. She has alleged that Shahbaz married her in the presence of a Maulvi and some other persons. She was forced to sign a marriage certificate, after which she was released. Later it was revealed that the Maulvi and the certificate were fake. He has alleged that he was threatened using abusive language over the phone.
