Court summons an AIIMS doctor in rape case
New Delhi. A Delhi court summoned an All India Institute of Medical Sciences (AIIMS) doctor on charges of raping a fellow female doctor on the pretext of marriage. However, Saket Court Metropolitan Magistrate Vijayashree Rathore considered the evidence on record as “prima facie sufficient” to proceed with the case against Dr Deepak Gupta. Cases were registered against Dr Deepak Gupta at Hauz Khas police station under IPC sections 376 (rape), 377 (unnatural offences), 313 (abortion without the consent of the woman) and 506 (criminal intimidation). “I take cognizance of the offense under sections 376, 377, 313 and 506 of the IPC against the accused,” Magistrate Vijayashree Rathod said after examining some important documents.
The magistrate said, “I have seen the challan, recorded statement and evidence under section 173 of CrPC. “From the allegations made against the accused and the material on record, prima facie it appears that all these things are sufficient to proceed with the case.” The court, through the concerned police station in-charge (SHO), directed to summon Dr. Deepak Gupta on 26 February. However, the court did not summon the accused’s two sisters and brother, saying that Gupta and the complainant were not married. Therefore, no specific allegation is made out against them and the three do not appear to have played any role in committing the alleged crime. According to the FIR, Dr Gupta, a professor of neurosurgery at AIIMS, allegedly raped the complainant, who is also a doctor, on several occasions on the pretext of marriage. He has been accused of forcing the complainant to undergo an abortion after a “sham marriage”.
