Court asks Police Commissioner to initiate investigation against investigating officers in North East Delhi violence case
New Delhi (ANI): Delhi’s Karkardooma Court has recently expressed strong displeasure over the investigation conducted on the basis of hearsay in the North East Delhi riots case.
The court has referred the matter to the Delhi Police Commissioner to initiate a department-level inquiry against the investigating officers (IOs) who wasted his time.
This case is related to the FIR registered in Gokul Puri police station in 2020.
Additional Sessions Judge (ASJ) Pulastya Pramachala said, “It is very painful that the previous IO literally wasted the time of this court by filing the investigation report based on hearsay.”
“Therefore, the matter is referred to the learned Commissioner of Police to initiate an inquiry at the departmental level with respect to the conduct of the previous IO in order to buy time from the court in the name of coming and going into the investigation. With a solid report of the investigation till date, the judge said in an order passed on October 19.
The court also said that it is also expected that the authorities concerned should be sensitized not to waste the time of the court at least on false pretenses.
The court has directed to send a copy of the order to the commissioner.
The court was considering an application filed by the current IO seeking permission to conduct further investigation in the riot case.
The judge said, “If one looks at the orders passed in this case at least from 07.09.2022 till now, it will become clear how much time was bought on the part of the previous IO to come up with a concrete report of the investigation “
The Court further noted that a supplementary charge sheet was also filed, but the quality of that investigation report is well reflected in the above mentioned application filed by IO/SI Arvind Verma.
The IO filed an application for permission to conduct further investigation and obtain information regarding the exact time and date of each incident clubbed for investigation in this case.
He also said that the timing of the alleged incidents mentioned in the previous chargesheets so far are based on the statements of the complainants/witnesses, who had not themselves witnessed the incidents and who had mentioned such timings on the basis of receiving such information.

The Special PP also submitted that this information is based on hearsay and, therefore, there is a need to further interrogate the complainants and witnesses to obtain information about the persons who witnessed the incidents and who Could tell the actual time of events. Every incident.
The court passed a direction on 19.01.2023 to file a statement of evidence to show the date and time of each incident leading to prosecution in this case. Subsequently, the IO filed the present application. He also asked for one to one and a half month’s time to complete further investigation.
The court listed the matter for December 13, 2023, for further investigation report.
The Court directed that on the same date, the Court would also expect acknowledgment from the office of the learned Commissioner of Police regarding receipt of the above mentioned observations. (ANI)
