High Court did not consider the complaint of debtor teacher as a crime, know what is the whole matter

Bilaspur. The High Court has given an important verdict in a case of abetment to suicide. The court said that if a person has given money to someone on loan, he is entitled to get it back. Asking for the return of loaned money does not amount to instigating suicide. The High Court has rejected the FIR registered on charges of abetment of suicide.

In fact, Naresh Yadav, a teacher by profession, presented a government scheme related to the Prime Minister Skill Development Scheme to Shaila Singh and asked her to invest money in it.

Shaila Singh gave approximately Rs 10 lakh to Naresh. After taking the amount, Naresh Yadav did not return his share to the concerned organization including the petitioner’s organization. When he called to get the amount back, Naresh stopped picking up the phone.

The angry petitioner threatened Naresh of dire consequences if he did not return the amount. Troubled by this, the king’s wife committed suicide by consuming poison out of fear. On Naresh’s complaint, the police registered the crime of abetment of suicide under Section 306 against the petitioner and presented the charge sheet in the court.

The petitioner had demanded quashing of the FIR and charge sheet. After hearing the case, the High Court has given relief to the petitioner and canceled the FIR lodged by the police and the order of the trial court.
