Husband doubted character, teacher wife got permission to divorce
Bilaspur. Chhattisgarh High Court has given permission to a female teacher to divorce her husband. The court said in its decision that abusing the teacher’s wife in front of students is ‘mental cruelty’. The court also said that a husband abusing his teacher wife with foul language in front of his students would not only tarnish his image in the society but would also amount to mental cruelty under the Hindu Marriage Act.
The division bench of Justice Gautam Bhaduri and Justice Deepak Kumar Tiwari was hearing the case. The bench accepted the plea of a woman seeking divorce from her husband on the grounds of cruelty. The allegation is that when the wife used to work and sometimes came home late, the husband used to question the character of the wife. . When the wife started giving tuition to the children at her home, the husband used to speak abusively.
The High Court said, “Questioning the character of the wife will naturally tarnish the image of the wife in the society, especially in front of the students.” The court said that initially the wife was not accepted by her in-laws because it was a love marriage. The woman argued that her husband was unemployed and hence she took up a job of teaching in a school to manage the family expenses. Due to workload she sometimes came home late. Her husband did not like that she worked and doubted her character and often accused her of having illicit relations with some male colleagues.
