CGPSC reprimanded on doctor’s petition, High Court gave instructions for appointment
Bilaspur. The High Court has reprimanded CGPSC for depriving the candidate included in the waiting list under the guise of rules and has ordered to give appointment. Petitioner Dr. Mahendra Sahu had secured second position in the waiting list for the post of Forensic Science Scientist in the 2014 PSC examination.
The candidate included in the first position had already been appointed to the post of lecturer in a college, hence he did not accept the post of PSC. He was given enough time for this. When the first placed candidate was not appointed, Sahu, who was in the waiting list at the second position, applied to CGPSC for his appointment. CGPSC wrote a letter to the state government on this and sought consent.
There was a delay in giving consent from the Health Department of the State Government. After this, CGPSC refused to give appointment saying that the validity of appointment in the waiting list had expired on 23 June 2016.
The candidate corresponded on this and said that the delay was not from his side but in the correspondence between the government and CGPSC. He had filed a petition in the High Court on refusal of appointment. The High Court reprimanded the Chhattisgarh Public Service Commission that a candidate who has reached the stage of selection after hard work under the guise of rules cannot be deprived of the opportunity.
