CJI DY Chandrachud said- important role of judges in social development

Washington DC (ANI): Chief Justice of India (CJI) DY Chandrachud on Monday said judges, though not elected, play an important role as the judiciary exerts a stabilizing influence on the society as it adapts to the advent of new technologies. Is developing rapidly.

CJI Chandrachud made the remarks while speaking at the third comparative constitutional law debate on the topic ‘Perspectives of the Supreme Court of India and the United States of America’. The event was organized by Georgetown University, Washington, DC. The CJI said there are constitutional values that are eternal and vital for the survival of nations, adding that democracy and the rule of law will ultimately survive and prosper.

The CJI said, “I think judges have a very important role. “Although we are not elected, we do not go to the people every five years to ask for votes.”
He said he believes the judiciary is “a stabilizing influence in the development of society, which is now evolving so rapidly with technology.”
“We represent, in a certain sense, the voice of something that must endure beyond the vagaries of time,” the CJI said.
“I think we have a role to play in the overall stability of our civilizations, our cultures, especially in the context of a pluralistic society like India,” he said.

CJI Chandrachud said he believes that courts today have become the central point of engagement for civil society and social change and hence people come to courts not only to get results but also “to have a voice in constitutional change”.
He said that when a lot is happening in our society, the courts have to play an important role in steering the ship.
He said the fundamental duty of judges is to look at the stories of discrimination faced by people and use the Constitution as a peaceful means to achieve social change.

He also said that “In many societies around the world, one can find that the rule of law has replaced the rule of violence. Therefore, the key to a stable society is the ability of judges to use the Constitution and their own.” Forum as a forum for dialogue, argument and discussion.
He said that the process of constitutional deliberation in the court promotes a new and emerging consensus. “In the consensus that has emerged through the process of judicial deliberations, there is hope for a better future for our societies,” the CJI said.
He said the Indian Constitution “speaks of brotherhood and reflects the equality, brotherhood and unique unity of our civilization.”
“So, in my opinion, when you interpret the Constitution, you interpret the Constitution as a living or organic document,” he said.
