Complaint filed against collector in Delhi Election Commission
Raipur: BJP has demanded a ministerial-level inquiry against Baroda Market Collector Chandan Kumar for misuse of power and position. Dr. Party’s Election Commission Liaison Committee Chairman Vijay Shankar Mishra asked the Chhattisgarh Election Commissioner in New Delhi to lodge a complaint against targeted illegal activities on the instructions of Baroda Market Collector Chandan Kumar.
Continuous movement of laborers in Baroda Mandi should be stopped. On the orders of Collector Chandan Kumar, Baroda Bazaar SDM officials were arrested under Section 151 of the Code of Criminal Procedure, preventive measures were taken and election material was also confiscated. BJP officials did not do anything that would make them liable for any cognizable offence.
In such a situation, taking preventive measures on the basis of Section 151 of the Code of Criminal Procedure is against the law. According to Section 151 of the Code of Criminal Procedure, jurisdiction is limited only to potentially cognizable offences, otherwise to cases in which there is clear abuse of power and position through failure to follow prescribed procedures at the time of arrest. According to Article 151 of the Code of Criminal Procedure, the period of detention of a person cannot exceed 24 hours. Prescribed procedures must be followed before arresting a person.
No action was taken against the employees. Baroda Market Collector Chandan Kumar was illegally arrested by Baroda Market Collector Chandan Kumar to stop him from misusing his position for election campaigning for the Bharatiya Janata Party. Bharatiya Janata Party had recommended him. BJP has demanded a ministerial inquiry against the accused BJP workers and demanded their release.
