PIL filed in Supreme Court challenging restoration of Rahul Gandhi’s Lok Sabha membership
A Public Interest Litigation has been filed in the Supreme Court challenging the reinstatement of former Congress President Rahul Gandhi as a Lok Sabha member. The plea contends that once a member of Parliament or a State Legislature ceases to hold office under the law, he remains disqualified unless he is exonerated of the charges leveled against him.
Lucknow-based lawyer and petitioner Ashok Pandey requested the constitution bench to decide whether a person who has faced disqualification under the law, on the basis of a stay on conviction, is entitled to be or be elected as a Member of Parliament or a State Legislature. Will be eligible or not. In fact, on August 4, the Supreme Court had stayed Rahul Gandhi’s sentence in the ‘Modi surname’ defamation case. Rahul Gandhi’s Lok Sabha membership was lost in this case. The Supreme Court had noted that the trial judge had not given any reason for imposing the maximum sentence of two years.
Following the Supreme Court’s stay order, the Lok Sabha Secretariat restored Rahul Gandhi’s membership of Parliament on August 7. Rahul Gandhi was disqualified as an MP in the month of March this year. A Surat court had sentenced Rahul Gandhi to two years in jail in April 2019 for his controversial remark on ‘Modi surname’ during an election rally in Karnataka.
Rahul Gandhi’s comment was interpreted as an attempt to draw out an underlying connection between Prime Minister Narendra Modi and fugitive businessmen Nirav Modi and Lalit Modi.
