HC upholds order for central agency probe in job scam case
Kolkata (IANS) | A division bench of Justice Tapabrata Chakraborty and Justice Partha Sarathi Chatterjee of the Calcutta High Court on Thursday upheld a single-judge order for a central agency probe into the multi-crore municipal recruitment scam in West Bengal. The bench said that the school recruitment case and the municipal corporation recruitment case are interlinked.
The bench said, in both the cases the same person is involved. Such scams have left the young generation extremely disappointed. Therefore, there is no alternative to a central agency probe in this matter. The order of the single-judge bench was justified.
In fact, the recruitment of municipalities came to the fore when Enforcement Directorate (ED) officials were conducting a raid and search operation at the residence of private real estate promoter Ayan Sil in connection with the multi-crore school recruitment cases.
A central inquiry into the matter was originally ordered by Justice Abhijit Gangopadhyay of the Calcutta High Court. To challenge this decision, the state government first approached the Supreme Court. However, the apex court referred the matter back to the Calcutta High Court.
Following this, the state government approached the court of Justice Amrita Sinha of the Calcutta High Court. However, Justice Singh upheld Justice Gangopadhyay’s order and directed the central agencies to continue their investigation in the matter.
Subsequently, the state government approached a division bench of the Calcutta High Court comprising Justice Arjit Banerjee and Justice Apurba Sinha Ray, which recused itself from the hearing claiming that the matter did not form part of the subject matter of that bench’s hearing.
The matter was referred to a division bench of Justice Subrata Talukdar and Justice Supratim Bhattacharya, who recused himself on the same ground. Ultimately the matter was referred to the Division Bench of Justice Chakraborty and Justice Chatterjee.
