Officer husband got permission to divorce from wife, High Court gave its verdict
Bilaspur. Overturning the Family Court’s decision against the husband, an officer in the Central Institute, the High Court has said that accusing the husband of illicit relationship with his own mother comes under the category of cruelty.
The case is of Baloda Bazar district. In 2011, a youth living in Bhilai was married to an officer of an organization under the central government. He later shifted to Durgapur. Wife left her job there and started doing PhD in chemical engineering. During this, the relationship between the two deteriorated. On this, the husband filed an application in the family court demanding divorce. The court rejected the application. Against this, the husband filed a petition in the High Court, which was heard in the Division Bench of Justice Gautam Bhaduri and Justice Sanjay S. Aggarwal.
The High Court has said in its judgment that the woman’s wrong allegation of her husband having an illegal relationship with her mother cannot be set aside by saying that it was made in a momentary impulse. Such an allegation comes under the category of cruelty. Accepting the petition of the husband, the court, after assessing his income, has asked the wife to pay Rs 35,000 per month for maintenance.
