Petition filed in HC demands verification of qualifications and certificates of all doctors

New Delhi: A petition has been filed in the Delhi High Court seeking direction to the Center and the Delhi government to conduct time bound verification of medical qualifications and educational certificates of all medical doctors practicing in NCT of Delhi.

It was alleged in the petition that the quackery business is growing uncontrollably in Delhi. Quacks, who often lack legitimate medical qualifications, have exploited the opportunity presented by lax monitoring and compromised the integrity of the State Medical Council.

It was also alleged that these unscrupulous physicians operate with dangerous disregard for established medical protocols, posing a serious threat to the lives of suspected patients.

The petition said that in view of the recent news reports published in print as well as electronic media exposing the scam of fake doctors in a nursing home in Delhi, NCR and the manner in which it was being permitted by the regulatory body Immediate intervention of the court was demanded. They were repeatedly fired, ultimately resulting in the death of various victims.

Recently, in a sensational incident that came to light in Delhi’s posh Greater Kailash area, two doctors, a woman claiming to be a surgeon, a laboratory technician and several patients died. The petition states that technicians at the hospital were performing surgeries by posing as doctors/surgeons, resulting in the loss of lives of many victims.

Dr. Neeraj Aggarwal, who is said to be the owner of Aggarwal Medical Centre, is just an MBBS, who was working as a fake specialist to perform major surgeries in the hospital.
The petition further said that being an MBBS, he is not even qualified to perform surgeries.

Despite this, he is said to be performing 3000 surgeries in a calendar year. The plea said that much before the police busted the fake clinic racket in South Delhi’s posh colony, at least 13 complaints were filed with the Delhi Medical Council (DMC) against illegal doctors at Agarwal Medical Center since 2011. Were.

Despite various complaints filed against Dr. Neeraj Aggarwal and his associates, unfortunately, the DMC failed to act diligently and take strict action against them.

The petition states that as per National Medical Commission (“NMC”) records and police investigation, Dr. Neeraj Aggarwal is only MBBS, whereas on the contrary, Neeraj Aggarwal was granted MD registration by the DMC.

If DMC had taken timely action against Dr. Neeraj Aggarwal and his associates, the lives of many victims could have been saved. Unfortunately, the council has consistently allowed them to escape with minimal or no punitive measures, the petition said.

The petition has been filed by five petitioners, one of them a 6-year-old disabled child who suffered a brain injury at the hands of doctors at a private hospital in Delhi, where he was treated in the neonatal ICU soon after his birth. Was. , Due to this damage he has developed cerebral palsy and epilepsy. He eventually acquired a rare medical condition called “West Syndrome” and was disabled for the rest of his life. The remaining four petitioners are also victims of medical malpractice and some have even lost their loved ones due to medical malpractice.

The petition has been filed through lawyers Sachin Jain, Ajay Kumar Aggarwal and Sukrit Seth and has sought a direction from the court to constitute a high-powered committee which may include retired members. Judges and independent eminent members of the society monitor the verification process to ensure that the process of re-verification of doctors is conducted in a fair, ethical and transparent manner.

“Issue a direction to get some independent agencies like CBI investigated the functioning of the Delhi Medical Council in relation to the dangerous malpractices of granting fake registrations and protecting unqualified doctors,” the plea said.
