The criminal who raped a minor got 20 years’ imprisonment

Kondagaon. The court has sentenced the accused of raping a minor to twenty years of rigorous imprisonment and fine. Dilip Jain Public Prosecutor represented the government in this case. Public Prosecutor Dilip Jain said that against the accused Bhima Baghel (18 years) under sections 363, 366 (a), 376 (3) 376 (2) (n) of the Indian Penal Code and section 6 of the Protection of Children from Sexual Offenses Act 2012. The allegation is that on July 6, 2022, he seduced the minor victim and raped her under Kondagaon police station area. After the first information report was lodged by the victim’s brother/applicant on July 7, 2022, a crime was registered against the accused in Kondagaon police station and taken up for investigation. After thorough investigation of the case, the charge sheet was presented before the court.

Kondagaon district’s Additional Sessions Judge FTSC (POCSO), Kondagaon Judge Kamlesh Kumar Jurri, after hearing the case, has mentioned in his decision that sexual crime against children is a very sensitive matter which affects the physical condition of the victim. , mental and emotional and is related to honor, respect and family and social prestige and in the present environment, in view of the increasing number of sexual crimes against children and its adverse impact on the society and the increasing social anger over such shameful incident. Keeping this in mind, it would not be appropriate from any point of view to show any leniency in punishing a person guilty of such a crime.

Keeping in view the facts and circumstances of the case, accused Bhima Baghel was sentenced to 5 years rigorous imprisonment and a fine of Rs 1000 under section 363 of the Indian Penal Code. The penalty under Section 366(a) of the Indian Penal Code is 5 years rigorous imprisonment and a fine of Rs 1000. The penalty under Section 376(3) of the Indian Penal Code is 20 years rigorous imprisonment and a fine of Rs 1000. The penalty under Section 376(2)(n) of the Indian Penal Code is 10 years rigorous imprisonment and a fine of Rs 1000. Under Section 6 of the Protection of Lingering Offenses Act 2012, he has been sentenced to 20 years of rigorous imprisonment and a fine of Rs 1000/-. In case of default in non-payment of fine, an order has been passed to undergo additional rigorous imprisonment for 01-01-01 months respectively.
