The High Court has given its decision to end the 38 year old marriage, now this couple will separate.
Kerala. The Kerala High Court has intervened and decided to end the marriage that has been going on for the last 38 years. The court said that maintaining a marriage which has completely broken down would amount to cruelty to both the parties and would serve no meaningful purpose. It would be cruel to both parties to keep the parties together despite their irrevocable break up, according to a ruling by the apex court. The High Court took this decision after the appeal of the woman’s husband. The husband had filed a petition in the High Court against the decision of the family court. The husband claimed that the marriage had completely broken down. He also stressed that his wife and two children have neglected him and he has not even been invited to his son’s wedding.
However, the defendant denied the allegations leveled against him and said that minor quarrels in marriage cannot be considered as cruelty. The Family Court did not find the allegations amounting to any mental or physical cruelty in order to grant divorce and dismissed the petition. However, the High Court said that a 38-year-old marriage cannot be revived. The court said, “Maintaining the marriage is cruel to both the parties. No meaningful purpose will be served by it.” The court dissolved the marriage between the parties.
