Trademark Dispute Resolved in Favor of Geetham Restaurant Chain
The Madras High Court, on November 2, issued an interim order permitting the Geetham group of restaurants to resume operations under their brand, subject to modifications to their logo and the release of an advertisement providing specific clarifications.
Previously, the Geetham group, which had been franchisees of Sangeetha caterers and consultants, was barred from conducting business under the Geetham brand following a single judge’s order on September 22. This restriction was the result of a lawsuit initiated by Sangeetha caterers and consultants Pvt Ltd, which accused the Geetham group of breaching the franchise agreement and infringing on their trademark and goodwill.
Upon considering arguments from both parties, the Madras High Court lifted the injunction, allowing the Geetham group to operate their establishments with an updated logo and after disseminating an advert stating that the Geetham brand and its associated trademarks are solely owned by GVR foods Pvt Ltd and are not affiliated with Sangeetha Caterers and Consultants LLP. This arrangement is to remain in place until the court makes a final decision on the main lawsuit.
