Commenting on someone’s dark complexion tantamounts to ‘cruelty’: Karnataka HC
Bengaluru (IANS). The Karnataka High Court, while hearing a divorce case, in its recent judgement, has said that racial slurs on black color amounts to ‘cruelty’.
The husband had filed an appeal petition in the court questioning the decision of the Family Court not to grant divorce. The Sub-Division Bench noted that the wife continuously insulted the husband for his dark complexion and harassed him by calling him a person with dark skin.
The bench said that to hide this fact the wife had accused him of illicit relationship. The bench, while ordering the setting aside of the trial court’s judgement, noted that it undoubtedly amounts to cruelty. The court also annulled the marriage and granted divorce to the husband.
The couple married in 2007, but the husband approached the family court for divorce in 2012, which dismissed the petition on January 13, 2017.
The petitioner claimed that after marriage his wife always used to taunt and humiliate him by calling him a black man. He somehow endured the humiliation for the sake of his daughter. He also claimed that his wife had filed a complaint against his aged mother and family members in 2011.
In this case, he also had to face torture and spent 10 days in the police station and court.
The husband had requested that the court grant the divorce. He claimed, “The wife went to her maternal home and never returned. He also complained to my employer. I suffered a lot and was also in depression.
The wife prayed for quashing of the petition and claimed that her husband had an affair and that she had a child from that affair.
She also alleged that her husband used harsh words and did not allow her to go out and come home late.
The wife had also filed a criminal complaint against her husband and his family members.
However, the court said that the wife has made baseless allegations against the petitioner.
The bench also said that the claim of the wife that she is ready to live amicably with her husband even after living without him for years and not withdrawing the complaint shows that she is not interested in living with her husband. Is.
After this, the court granted divorce to the husband on the ground of cruelty.
